Conclusion of the travel contract
With your travel registration, you offer LA TIBURONA ON TOUR the conclusion of a travel contract. Registration can be made in writing, by phone, messenger or by e-mail. The travel contract is concluded when we have sent you the booking confirmation. If the travel confirmation contains deviations from the registration, you are entitled to declare a non-acceptance in writing within 5 days, otherwise the travel confirmation becomes binding.
Services
The contractual services can be found on the website in the service description of the tour operator as well as on the related information in the travel confirmation. Ancillary agreements that change the scope of the contractual services require a written confirmation.
Deposit requirements:
You are required to pay a non-refundable 20%-deposit for your booking to be confirmed. If your booking is made within 45 days of the departure date then the full amount is payable at the time of booking.
Acceptance of booking and final payments
All payments are to be made after recieving the booking confirmation invoice. A deposit of 20% per person per trip is then required. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment.
Payment of the balance of the trip price is due 45 days before the departure date, except as otherwise set out in your booking confirmation.
A contract will exist between you and us from the date we issue the confirmation invoice. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any respective cancellation charges (Cancellation by You) will apply.
Itinerary- and price changes
Changes or deviations from individual travel services from the agreed content of the travel contract, which become necessary after the conclusion of the contract and which were not brought about by LA TIBURONA ON TOUR in good faith, are only permitted if the changes or deviations are not significant and do not affect the character of the booked trip. Minor changes to the itinerary as well as changes in the order are also allowed if the character of the trip does not suffer as a result. LA TIBURONA ON TOUR reserves the right to change the prices advertised and confirmed with the booking for objectively justified, significant and unforeseeable reasons (increase in transport costs, taxes, duties, fees, exchange rate changes) to the extent that their increase per person/per seat affects the travel price, provided that there are more than four months between the conclusion of the contract and the agreed travel date.
LA TIBURONA ON TOUR must inform the traveler immediately about changes to the travel price or an essential travel service, but at the latest before the start of the trip. Price increases after this time are inadmissible. In the event of price changes by more than 5% or a significant change in travel performance, the traveler is entitled to withdraw from the travel contract without fees. The withdrawal must be declared immediately.
Cancelation by You
If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation from you that you wish to cancel. If you cancel a trip:
Up to 45 days before departure: 20% of the tour price
44 to 30 days before departure*: 40% of the tour price
29 to 15 days before departure*: 60% of the tour price
14 to 10 days before departure*: 80% of the tour price
From the 9th day before departure and in case of no-show: 100% of the tour price
In any case, a processing fee in the amount of the deposit paid will be withheld.
*Tickets to tourist attractions ARE NON REFUNDABLE
Unused portions of services
If you do not make use of individual services as a result of early departure or for other reasons or if you change the services on site, LA TIBURONA ON TOUR will endeavour to reimburse the saved expenses to the service providers.
Warranty / remedy
All LA TIBURONA ON TOUR trips are intentionally designed to take clients “off the beaten track” to places where facilities, infrastructure, safety and other standards may not be sophisticated and may be different from those in a traveller’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveller, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated.
There are other risks associated with LA TIBURONA ON TOUR trips, such as theft or loss of or damage to property. Some of the services provided in connection with a trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom LA TIBURONA ON TOUR has no control.
Responsibility Clause
LA TIBURONA ON TOUR acts as a tour operator. The suppliers providing transportation, sightseeing arrangements and hotel accommodations for the tour program are usually independent contractors and are not agents or employees of LA TIBURONA ON TOUR. All coupons, receipts and tickets issued are subject to the terms and conditions specified by suppliers. By utilizing the service of the suppliers, you agree that LA TIBURONA ON TOUR will not be liable for any change in schedule, strikes, delay, acts of governments, fires, riots, theft, pilferage, epidemics, quarantine, medical or customs regulations, accident, loss, injury, or damage to you or to those traveling with you in connection with any accommodations, transportation or any other services or resulting directly or indirectly from any occurrence or conditions beyond its control, including defects in vehicles, breakdown in equipment, thefts, delay or cancellation of or changes in itinerary for any act, omission, or event during the time you are on board the aircraft. Neither LA TIBURONA ON TOUR and/or agents of the airlines concerned are to be held responsible for the late arrival of passengers at airports or resorts due to inclement weather, nor are they to be held liable for payment or any refund for unused hotel accommodations or meals occasioned by such late arrivals at the hotels holding rooms as confirmed itineraries.
If the trip suffers major defects from your point of view, please immediately contact your tour guide, so that a solution can be found. If you do not report defects on site, this may mean that you cannot assert any claims (reduction, damages) for these defects. Regardless of the notification on site, you must assert any claims for reduction/ damages with LA TIBURONA ON TOUR within a period of one month after the contractually provided end of the trip. If you make the decision on site to cancel the trip due to existing problems, you must also first report the defect in this case and set a reasonable period of time to find a solution so that you do not lose further claims.
Cancellation by the tour operator
LA TIBURONA ON TOUR can withdraw from the travel contract in the following cases before the start of the trip or terminate the contract after the start of the trip:
A) up to 30 days before the start of the trip If an advertised minimum number of participants is not reached (see respective travel advertisement). In any case, LA TIBURONA ON TOUR is obliged to inform the customer immediately after the conditions for the non-fulfilment of the trip have occurred and to immediately send him the declaration of withdrawal and, if necessary, a replacement offer. The customer will immediately receive the paid travel price back. Further claims on the part of the customer are excluded.
B) Exclusion If the participant persistently interferes with the execution of a trip, despite a warning, and thus behaves contrary to the contract, LA TIBURONA ON TOUR can terminate the contract if the immediate termination of the contract is justified. In this case, LA TIBURONA ON TOUR is still entitled to the agreed travel price.
Cancellation of the contract due to Force Majeure
If the trip is significantly complicated, endangered or impaired as a result of unforeseeable force majeure at the time of conclusion of the contract, both LA TIBURONA ON TOUR and the traveler can terminate the contract. If the contract is terminated, LA TIBURONA ON TOUR may demand reasonable compensation for the travel services already provided or still to be provided at the end of the trip. Furthermore, LA TIBURONA ON TOUR is obliged to take the necessary measures to return the traveler to the planned departure airport, if possible, or to another airport for departure. Incidentally, further additional costs incurred are borne by the traveler.
In the event LA TIBURONA ON TOUR determines to cancel a Scheduled Group trip for reasons of force majeure (including acts of war, terrorism, civil unrest, quarantine, curfew, natural disaster, pandemic, epidemic and other causes outside of the tour operators control), or if the quality of the trip or the safety of travellers is judged by LA TIBURONA ON TOUR to be compromised by factors external to us. In such a case, we will endeavour to refund payments received by LA TIBURONA ON TOUR, subject to the following limitations. We ask that our valued clients recognize that there are expenses, including unrecoverable third-party deposits, that LA TIBURONA ON TOUR cannot recoup as the planned date of a trip approaches and as a result, a refund is not always possible. However, we will make best efforts to recover, for the benefit of our travellers, as many of those expenses as we are able. Unrecoverable expenses will not be refunded.
Loss and damage of luggage
Loss or damage to luggage during the tour must be reported to the carrier immediately. It is obliged to issue a written confirmation. Without a report, there is a risk of loss of claim.
Passport, visa, customs and health regulations
It's the travelers responsibility to comply with all regulations requiered for carrying out the journey. All complications arising from non-compliance with passport, visa and health regulations are at the travelers expense. Due to current passport, visa and health regulations, reference is made to the information on the current country information of the Federal Foreign Office. LA TIBURONA ON TOUR will, as far as possible, inform the traveler of any significant changes. Please inform yourself about infection and vaccination protection as well as other prophylaxis measures and seek medical advice if necessary.
